1. Acceptance of Terms
By creating an account or using any part of the Cloud platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.
These Terms apply to all users, including sellers (account holders), their end-users, team members, and resellers.
2. Description of Service
Cloud is a software licensing and authentication platform that provides:
- License key generation, management, and validation
- User authentication and session management
- Hardware ID (HWID) binding and verification
- DRM (Digital Rights Management) with remote logic
- Application configuration, variables, and file hosting
- Webhook integrations and API access
- Team management and reseller systems
3. Account Registration
To use our Service, you must:
- Be at least 16 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized use of your account
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Distribute malware, ransomware, or any malicious software
- Facilitate illegal activities or violate any applicable laws
- Infringe on intellectual property rights of third parties
- Attempt to bypass, disable, or interfere with the Service's security features
- Reverse engineer, decompile, or disassemble the Cloud SDK or DRM system
- Use the Service to conduct DDoS attacks or abuse API rate limits
- Resell or redistribute the Service without authorization
- Impersonate other users or entities
Violation of these terms may result in immediate account termination without refund.
5. Subscription Plans and Billing
5.1 Plans
We offer multiple subscription tiers (Free, Starter, Pro) with varying feature limits. Plan details and pricing are available on our website and may change with prior notice.
5.2 Payments
Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. All prices are displayed in the currency configured by the platform. Prices are exclusive of applicable taxes unless stated otherwise.
5.3 Cancellation
You may cancel your subscription at any time through the dashboard. Upon cancellation, your account will revert to the Free plan at the end of the current billing period. No prorated refunds are provided for partial billing periods.
5.4 Refunds
Refunds are considered on a case-by-case basis within 14 days of purchase. Contact support to request a refund. Refunds are not available for usage already consumed.
6. Intellectual Property
6.1 Our Property
The Cloud platform, including its source code, SDK, DRM system, documentation, design, and branding, is the exclusive property of Cloud and its licensors. All rights not expressly granted are reserved.
6.2 Your Content
You retain ownership of your application data, configurations, and content uploaded to the platform. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service.
7. SDK and DRM Usage
The Cloud SDK is provided for integration into your applications. You agree to:
- Use the SDK only with valid Cloud licenses
- Not distribute the SDK source code or reverse engineer the compiled libraries
- Inform your end-users that hardware identifiers are collected for license validation
- Comply with applicable privacy laws regarding end-user data collection
8. API Usage
Access to our APIs is subject to rate limits based on your subscription plan. You agree to not circumvent rate limits, abuse API endpoints, or use automated systems to excessively load our infrastructure.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of the platform complies with applicable data protection laws (including GDPR) in relation to your end-users' data.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, upgrades, or emergency repairs. We are not liable for any losses resulting from service interruptions.
11. Limitation of Liability
To the maximum extent permitted by law, Cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Cloud, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. We may delete your account data after 30 days following termination.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Paris, France.
15. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through a notice on our platform. Continued use after changes constitutes acceptance of the revised Terms.
